my company vsl m.v.spring rainbow was arrested in congo, west of africa week ago due to similar reason, my vsl did one tct to Chun An dalian, and they sublet my vessel to Cingler which was operated by Indian people. UBT/BMS can not collect the bunker charge from Cingler, so my vsl was arrested in congo until my company paid, we lost a lot of money and vsl delayed one week long. according to english law, bunker trader has no rights to detain my vsl because all of bunker on board was consumed during that voy. but trader took full advantage of africa law to grant a lien from congo court. we know that they want to collect money, but who authorised the credit to this kind of poor operator, it was BMS/UBT to want make profit and after failing to collect money, they claim from ows.

We wish to comment that We always act within the law when protecting our interests and the action taken by UBT/BMS in this matter was in all respects lawful. Numerous approaches were made to the owners of the M/V SPRING RAINBOW to invite a discussion about the situation we each faced. The representative flatly denied ANY kind of settlement and indeed laughed at our proposal. Both parties are constrained by a confidentiality clause, so we were very surprised and disappointed to see the owner’s comments and are obliged to limit our own.

regarding a shipowner blaming bunker traders giving credits to such poor charterers, can I just ask shipowner friends why they give their ships to such poor charterers so easily ??? Bunker traders may be giving 250/500k credits but shipowners leaving 5/10 mio value ships to such hands, what kind of conflict is this ? Whom to blame ?

If ship owners do not care about who is chartering their ships and doing nothing about such risk, they face such cases at the end. They have to ask certain guarantees from such charterers, otherwise it is also being unfair competition for good charterers paying bunker bill and such bad ones pushing freights further down that shipowners are losing at both platforms. Yes we all know that market is too bad and shipowners may be just happy to find chareterer and giving them ships so eaisly without any security, but it makes market further bad then they can not really cry ; shipowners unfo shutting their legs themselves

Industries ; shipowning and bunkering, both, should do something on this matter. Everthing starts with ship and shipowner, without ship/shipowner there is no charterer/freight and bunkering so it is shipowners role to secure it, if they are careful and putting some rules asking kind of securities when chartering out their ships such cases can be limited. It needs closer cooperation and open talks between market players such as owners, charterers and bunker suppliers & traders

In this concern, there is a lot of advantages for ship owners to be member of IBIA (www.ibia.net) They can be closer to bunkering community and can get good infos and support there
